Terms of use

1. Purpose

Leadsoon is an online platform that brings together four tools: preparing ad campaigns, a CRM to follow up prospects, an email sending service and a results dashboard.

2. What you buy

You take out a monthly subscription to one of the three Leadsoon plans: Essentiel, Pro or Full. Each plan gives access to the platform and includes a number of creations per month, for the ad platforms it covers: Facebook and Instagram for Essentiel, plus TikTok and Google for Pro, and every channel for Full. The details and current prices are on the Pricing page.

No commission is taken from your ad budget. This budget is separate from the subscription: you pay it directly to the ad networks, on your own ad accounts. Leadsoon neither receives nor manages it.

2a. Results

The subscription pays for the platform and the creations, not for a number of prospects. Leadsoon passes the requests your campaigns produce into your space and your CRM, without guaranteeing their volume or their conversion into customers.

3. Nature of the recommendations

Estimates of volume, cost per prospect and revenue are orders of magnitude calculated from sector market benchmarks, adjusted with the information you provide. They are not guaranteed results. Actual performance depends on your offer, your market, your visuals and how quickly you handle the requests you receive.

4. Your contacts

The contact details your campaigns bring you belong to you. You can export them at any time and delete them permanently. Leadsoon does not resell them, does not pool them between accounts and does not use them on its own behalf.

In return, you are responsible for processing them: informing the people concerned, the legal basis, answering their requests. You guarantee that the contacts you import into Leadsoon were collected lawfully.

5. Sending emails

Messages are sent in your name. You agree to comply with the regulations on electronic prospecting: clear identification of the sender, a subject related to the recipient’s role, and immediate handling of any objection.

Three rules are enforced by the platform and cannot be turned off: every message contains an unsubscribe link, anyone who unsubscribes is never contacted again, and sending volumes are capped in proportion to the agreed volume of prospects.

An abnormal complaint rate may lead to the sending feature being suspended while the cause of the problem is found. This protects deliverability for all users.

6. Account

You are responsible for keeping your password confidential and for the actions taken from your account.

7. Acceptable use

You agree to comply with the advertising rules of the platforms you use, and with the regulations that apply to your business (mandatory notices, claims, regulated sectors). The texts Leadsoon suggests are suggestions: you remain responsible for what you publish.

In particular, it is up to you not to reuse as-is any claims you cannot back up. The places where a figure or proof must be inserted are clearly marked in square brackets in the suggested texts.

The following are forbidden: sending messages to lists that were bought or collected without consent, identity theft, and using the platform for unlawful content.

8. User responsibility

The user acknowledges being solely responsible for the lawfulness of their business and of the products or services they wish to promote, and for obtaining and keeping all the approvals, authorisations, licences or accreditations needed to carry out and promote their business.

When Leadsoon identifies a regulated business, or one that may be subject to advertising restrictions, the user must confirm, before the campaign is launched:

“I acknowledge that my business may be subject to specific regulations or require an approval. I confirm that I hold the authorisations needed to carry out and promote this business.”

For campaigns that may be limited or rejected by Meta, Google or any other ad platform:

“I acknowledge that this campaign may be subject to restrictions, checks or rejection by the ad platforms. I confirm that I wish to go ahead with submitting it, aware of these constraints.”

These confirmations are time-stamped and kept with the campaign.

Campaigns run from your own ad accounts: you alone remain responsible for their compliance with the ad networks’ rules and for the consequences of those accounts being refused or suspended. Leadsoon reserves the right to refuse to prepare a campaign that clearly breaks these rules or the law, without this refusal being a breach of its obligations.

9. Limitation of liability

Leadsoon cannot be held liable for a campaign being rejected, suspended or limited by an ad platform, nor for the consequences of a missing approval, authorisation or mandatory declaration that is the user’s responsibility. Leadsoon does not guarantee that a third-party platform will accept a campaign.

The tools, recommendations and alerts Leadsoon provides help with preparing and running campaigns, and do not replace the user checking their own legal, regulatory or professional obligations. In particular, the automatic detection of regulated sectors relies on analysing the description the user provides: its silence is not a certificate of compliance.

These limits apply neither to Leadsoon’s essential obligation (providing the tools to prepare campaigns and passing on the prospects actually received through your pages and forms) nor where the law excludes them.

10. Personal data processed on your behalf

For prospects’ contact details collected by your campaigns and processed in the CRM and the sending service, you are the controller and Leadsoon acts as processor within the meaning of the GDPR.

Subject and duration: collecting, hosting and making prospects available, for as long as you use the service. Nature and purpose: enabling the user’s commercial prospecting. Data: identity, contact details and answers to the qualification form. Data subjects: the prospects who filled in a form.

As such, Leadsoon undertakes to process this data only on your documented instructions, to bind the people authorised to access it to confidentiality, to take the required security measures, to help you answer requests to exercise rights and in the event of a data breach, to use a sub-processor only with your authorisation, and to delete or return the data when the relationship ends. The information needed to demonstrate these obligations is available to you on request.

For your part, you guarantee the lawfulness of the collection, that people are informed, and the legal basis for the processing you carry out with this data.

Processing the data of your own account (login details, billing, use of the service), on the other hand, is Leadsoon’s responsibility as controller, under the conditions described in the privacy policy.

11. Demonstration phase

The service is offered in a demonstration phase: no payment is taken, the volume of prospects can be set freely, and no availability is guaranteed. Accounts created during this phase may be reset, after notice.

12. Ownership

The service, its recommendation engine and its presentation remain Leadsoon’s property. Your campaigns, your contacts and your messages belong to you.

13. Termination

You can stop using the service at any time and retrieve your data before leaving. We may suspend an account that is used in breach of these terms.

14. Publisher and governing law

The service is published by Scale4Scale LLC, a company incorporated under US law (Wyoming), whose full details are in the legal notice.

These terms are governed by French law.
